1. Acceptance of Terms
By creating an account, accessing, or using any part of the SMSCodeHub platform (the "Service"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"), as well as our Privacy Policy.
If you do not agree to these Terms, you must immediately discontinue use of the Service. These Terms constitute a legally binding agreement between you and SMSCodeHub (the "Company," "we," "us," or "our"), a telecommunications aggregation service provider registered and operating under the laws of the Republic of Poland.
2. Nature of Service - Aggregator Model
2.1 Service Description
SMSCodeHub operates as a telecommunications intermediary and aggregator. We do NOT own, operate, or control the underlying telecommunications infrastructure, SIM cards, or mobile networks. Instead, we:
- Connect users to third-party SMS service providers including, but not limited to: 5sim.net, GrizzlySMS, SMS-Man, and other API partners (collectively, "Upstream Providers").
- Aggregate pricing, availability, and routing information from multiple Upstream Providers to offer users the best available options.
- Facilitate payment processing and provide a unified user interface for number selection and SMS retrieval.
2.2 No Hardware Ownership
The Company does not own, lease, or possess any physical telecommunications equipment, SIM cards, or network infrastructure. All virtual phone numbers are leased in real-time from Upstream Providers who maintain their own networks and regulatory compliance.
2.3 Limitation of Responsibility for Third-Party Infrastructure
Important Notice:
We are NOT responsible for:
- Network outages, maintenance, or technical failures of Upstream Provider networks
- SMS delivery delays caused by carrier routing or regulatory restrictions
- Number availability fluctuations due to carrier inventory changes
- Compliance violations committed by Upstream Providers (we vet partners but cannot guarantee their adherence to all local regulations)
3. Account Registration & Eligibility
3.1 Age Requirement
You must be at least 18 years of age to use this Service. By registering, you represent and warrant that you meet this age requirement.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account, including unauthorized access resulting from credential sharing
- Immediately notifying us at support@smscodehub.com if you suspect unauthorized access
3.3 One Account Per User
Users are permitted only one account. Creating multiple accounts to circumvent restrictions, abuse promotions, or engage in fraudulent activity will result in immediate suspension of all associated accounts without refund.
4. Prohibited Uses - Zero Tolerance Policy
CRITICAL: Violations Result in Immediate Account Termination
Any use of our Service for illegal, fraudulent, or abusive purposes will result in immediate permanent ban without refund. We actively cooperate with law enforcement agencies worldwide.
4.1 Strictly Prohibited Activities
You may NOT use SMSCodeHub virtual numbers for:
- Spam & Unsolicited Communications: Sending bulk SMS messages, promotional content, or any unsolicited communications without explicit recipient consent.
- Phishing & Social Engineering: Creating fake accounts, impersonating individuals or organizations, or deceiving others to obtain sensitive information.
- Fraud & Financial Crime: Money laundering, credit card fraud, identity theft, tax evasion, investment scams, or pyramid schemes.
- Illegal Account Creation: Registering accounts on platforms where you are banned, creating fake identities to bypass KYC/AML regulations, or violating platform terms of service for malicious purposes.
- Harassment & Abuse: Stalking, doxing, revenge porn distribution, cyberbullying, or threatening individuals.
- Hate Speech & Extremism: Promoting terrorism, inciting violence, distributing extremist propaganda, or engaging in activities that violate anti-discrimination laws.
- Botnet Operations: Using numbers for DDoS attacks, botnet command & control, or automated credential stuffing.
- Child Exploitation: Any activity related to child sexual abuse material (CSAM) or solicitation of minors. We report such activities immediately to NCMEC and Interpol.
4.2 Automated Detection & Reporting
We employ automated fraud detection systems that monitor:
- Patterns of abnormal usage (e.g., requesting 100+ numbers in 24 hours)
- Association with known fraud databases and IP blacklists
- Correlation with reported scam campaigns
Accounts flagged by these systems may be automatically suspended pending manual review.
4.3 Cooperation with Law Enforcement
We maintain detailed logs of account activity, payment transactions, and API requests. This data may be disclosed to law enforcement agencies pursuant to valid legal process (subpoenas, court orders, search warrants) as required under Polish and EU law.
5. Payments, Billing & Refunds
5.1 Pricing & Currency
All prices are displayed in USD (United States Dollars) unless otherwise specified. Prices are subject to change without notice, but changes will not affect orders already placed.
5.2 Payment Methods
We accept:
- Credit/Debit Cards: Processed via Stripe, Inc. (PCI DSS Level 1 compliant)
- PayPal: Subject to PayPal's terms and policies
- Cryptocurrency: Bitcoin (BTC), Ethereum (ETH), USDT, Litecoin (LTC), and other supported coins via automated payment gateways
5.3 "No Code = No Charge" Guarantee
Our Refund Promise:
If you do not receive an SMS verification code within the timeout period (typically 15-20 minutes), you will NOT be charged. The transaction will be automatically reversed, and credits will be returned to your account balance.
5.4 Distinction: Balance Top-Up vs. Service Usage
- Balance Top-Up: When you add funds to your account (e.g., $10.00), this is a final transaction. We do not offer refunds on unused account balance except as required by law or in cases of proven service failure.
- Service Usage: When you use balance to rent a number and do not receive the SMS code, the specific transaction is refunded per the "No Code = No Charge" policy.
5.5 Cryptocurrency Payment Disclaimer
Cryptocurrency transactions are irreversible by design. Once a blockchain transaction is confirmed:
- We cannot reverse or refund the payment on-chain
- Refunds for unused balance (if approved) will be issued as account credits, not on-chain refunds
- Users are responsible for verifying wallet addresses before sending funds
5.6 Chargebacks & Disputes
Filing an unauthorized chargeback or payment dispute for services rendered in good faith is considered fraud. Such actions will result in:
- Immediate account termination
- Blacklisting from future service access
- Potential legal action to recover losses and fees
6. Service Availability & Guarantees
6.1 Uptime & Availability
While we strive for 99.9% uptime, we do NOT guarantee uninterrupted service availability. Scheduled maintenance, emergency repairs, or force majeure events (e.g., natural disasters, cyberattacks on Upstream Providers) may cause temporary service disruptions.
6.2 Number Availability Fluctuations
The availability of phone numbers from specific countries or for specific services (e.g., WhatsApp, Google) depends on Upstream Provider inventory. We cannot guarantee:
- That a specific country code will always be available
- That numbers will always work for a specific service (some platforms dynamically update their VoIP/virtual number detection algorithms)
6.3 SMS Delivery Time
Typical SMS delivery occurs within 30 seconds to 5 minutes. However, delays up to 20 minutes can occur due to carrier routing, international gateway latency, or service provider throttling. If no SMS is received after 20 minutes, the activation is automatically canceled with full refund.
7. Intellectual Property Rights
All content on the SMSCodeHub website, including but not limited to:
- Logo, trademarks, and brand assets
- Software code, algorithms, and API documentation
- Text, graphics, user interface design
...is the exclusive property of SMSCodeHub or its licensors and is protected by Polish, European Union, and international copyright, trademark, and intellectual property laws.
You may NOT:
- Reverse engineer, decompile, or disassemble any part of our platform
- Use our trademarks without written permission
- Scrape, crawl, or automatically extract data from our website
8. Limitation of Liability
IMPORTANT LEGAL DISCLAIMER
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.1 No Liability for Consequential Damages
To the maximum extent permitted by applicable law, SMSCodeHub shall NOT be liable for:
- Loss of Access: If you lose access to a third-party account (e.g., Tinder, WhatsApp) due to number recycling or platform bans
- Financial Loss: Lost profits, business interruption, or investment losses resulting from service use or unavailability
- Data Loss: Loss of SMS message content due to technical failures or expired message retention periods
- Reputational Damage: Harm to personal or business reputation arising from third-party misuse of numbers you rented
8.2 Liability Cap
Our total aggregate liability to you for any claims arising from these Terms or use of the Service shall NOT exceed the amount you paid to SMSCodeHub in the twelve (12) months preceding the claim.
8.3 Indemnification by User
You agree to indemnify, defend, and hold harmless SMSCodeHub, its directors, employees, and partners from any claims, damages, or legal costs arising from:
- Your violation of these Terms
- Your infringement of third-party intellectual property or privacy rights
- Your use of the Service for illegal purposes
9. Indemnification
You agree to indemnify and hold harmless SMSCodeHub, its affiliates, officers, directors, employees, agents, and Upstream Providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your breach of these Terms of Service
- Your violation of any law or regulation
- Your violation of any rights of a third party, including intellectual property rights or privacy rights
- Any content you submit, post, or transmit through the Service
10. Termination of Service
10.1 Termination by User
You may terminate your account at any time by emailing support@smscodehub.com. Unused account balance may be refunded at our discretion, subject to verification of non-violation of these Terms.
10.2 Termination by SMSCodeHub
We reserve the right to suspend or terminate your account immediately, without prior notice, if:
- You violate any provision of these Terms
- Your account is flagged by automated fraud detection systems
- We receive a valid legal order requiring account termination
- Your payment method is declined or you initiate unauthorized chargebacks
Upon termination, you forfeit all unused account balance and access to historical data.
11. Governing Law & Jurisdiction
Legal Jurisdiction
These Terms of Service and any disputes arising out of or related to these Terms or the use of the Service shall be governed by and construed in accordance with the laws of the Republic of Poland and the applicable regulations of the European Union, without regard to conflict of law principles.
11.1 Exclusive Jurisdiction
Any legal action, suit, or proceeding arising out of or relating to these Terms or the Service must be instituted exclusively in the competent courts for the city of Siedlce, Masovian Voivodeship, Poland. You irrevocably submit to the exclusive jurisdiction of such courts and waive any objection to venue or inconvenient forum.
11.2 EU Consumer Rights
If you are a consumer resident in the European Union, nothing in this clause affects your rights under EU consumer protection regulations, including the right to bring proceedings in your country of residence.
11.3 Arbitration Waiver
You and SMSCodeHub agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify registered users via email (if an email address is on file)
- Display a prominent notice on the website for 30 days
Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must discontinue use of the Service and may request account termination.
